Terms of Service

1. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use gramatic. You are responsible for the activity that occurs under your account and for keeping your credentials and API keys secure. Notify us promptly of any unauthorised use.

2. The service

gramatic lets you generate images using third-party AI models on a pay-as-you-go basis. Models, their capabilities, and their credit costs may change over time. We may add, modify, or remove models and features at our discretion.

3. Credits and billing

• Generation is paid for with credits. Each model has a fixed credit cost shown before you generate.
• Credits are held when you submit a generation and charged only when it succeeds. If a generation fails or is canceled, the hold is released back to your balance.
• Credit top-ups are processed by our payment provider, Stripe. Purchased credits do not expire. Pricing and refund terms are described in our Refund Policy.

4. Acceptable use and content

Your use of gramatic must comply with our Acceptable Use Policy and Content Policy. You are responsible for the prompts you submit and the images you generate, and for ensuring they do not infringe the rights of others or violate applicable law.

5. Your content and ownership

As between you and gramatic, you retain such rights as you may have in the prompts you submit and the images you generate, subject to these Terms and the terms of the underlying model providers. You grant us a limited licence to process and store your prompts and outputs solely to operate and improve the service (for example, to power your gallery and usage history and to deliver the images to you). AI-generated output may be similar to output produced for other users, and the legal status of rights in AI-generated material varies by jurisdiction.

6. Third-party services

gramatic relies on third-party providers including Replicate (model inference), Clerk (authentication), Convex and Cloudflare R2 (infrastructure and storage), Stripe (payments), and Resend (email). Your use of the service is also subject to those providers' terms where applicable.

7. API use

API keys are issued to you and must be kept confidential. We may apply rate limits and may suspend keys that we reasonably believe are being used abusively or insecurely. You are responsible for all activity performed with your keys.

8. Suspension and termination

We may suspend or terminate your access if you breach these Terms or use the service in a way that creates risk or legal exposure for us or others. You may stop using the service at any time. Provisions that by their nature should survive termination will survive.

9. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that generated images will be accurate, suitable for a particular purpose, or free of objectionable content.

10. Limitation of liability

To the maximum extent permitted by law, gramatic and Valeon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data. Our aggregate liability arising out of or relating to the service will not exceed the amounts you paid to us in the three months preceding the event giving rise to the claim.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above, and where appropriate we will provide additional notice. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Valeon is established, without regard to conflict-of-laws principles.
